There are many risks and dangers associated with boating, jet skiing and activities around and in the water; there are risks of collisions, falls, injuries to the spine, arms and legs, pinching, drowning, and death that can arise from the negligence of others, your own negligence, weather conditions, acts of God, water conditions and your own experience and abilities.

For your own safety and the safety of your friends and family who may be participating in your rental activity, it is important that you understand the risks and explain and manage them to every member of your party.

I, the undersigned, acknowledge that I am voluntarily participating in the rental of a jet ski from Lake View Watersports Inc. In consideration of being permitted to use the jet ski, I assume all risks associated with jet skiing, including but not limited to the risks of personal injury, property damage, and death.

I hereby release, discharge, and hold harmless Lake View Watersports Inc., its owners, employees, agents, and representatives from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, or other loss that may arise out of my use of the jet ski. This release applies to any negligence, act, or omission by Lake View Watersports Inc. its owners, employees, agents, or representatives.

I agree that I will not sue or make a claim against Lake View Watersports Inc. for damages or injuries caused by the negligence, breach of contract, or breach of any statuary or other duty of care, which include any duty of care owed under the OCCUPIERS’ LIABILITY ACT, R.S.O. 1990, c. O.2, or other faults of the “released parties”. If I and/or my child/ward are injured, I acknowledge that I and/or my child/ward may require medical assistance, which I acknowledge will be at my own expense or the expense of my personal Insurer(s). I hereby represent/affirm that I have adequate insurance to provide coverage for such medical expenses. I understand and agree thatLake View Watersports Inc. will not pay for any cost or expenses incurred by me if I and/or my child/ward are injured.

I understand that I am responsible for the proper care and safe operation of the jet ski during the rental period. I agree to return the jet ski in the same condition in which it was received.

1. Do not pick up passengers from any dock. Board the watercraft from the water this will eliminate any damage
2. You are now the operator of a Jet Ski, always look in all directions for other boats before turning. Keep a distance of at least 500 feet from all boats and shorelines and the waterpark.
3. Do not splash, approach, or cross the path of any other watercraft in your group or on the lake.
4. Always wear a PFD and securely attach the lanyard/Key. PFDs, fuel, anchor and safety equipment are included with the rental price.
5. If the lanyard/Seadoo’s Key is lost, a 30.00/100.00 cost will be taken from the deposit.
6. Turns cannot be made without applying throttle.
7. If you should capsize the watercraft upright it as soon as possible.
8. There are no brakes on a personal watercraft; the stopping distance is approx. 300 feet from full speed; therefore, stay away from other riders.
9. Don't jump boat wakes or cross the paths of boats and watercraft.
10. There will be an overage charge of up to 35.00 dollars per 10 minutes if you are late and go over your time limit.
11. You must obey the no-wake zones between the rental site and the riding area. Go slow on your way out to the lake. Your time will not start until you reach the riding area. I understand that I am not to leave the designated riding area because of water hazards and safety.
12. If any of the above rules are broken Lake View Watersports Inc. Has the right to withhold the deposit required to rent the personal watercraft.
13. Do not sink the watercraft. If this does happen, do not start it with water in the motor. This will create excessive damage.
14. All persons in my party & I have not consumed alcohol or Narcotics prior to this activity and will not participate in this activity while renting from Lake View Watersports Inc.

I have carefully read and understand the above riding instructions, and fully understand that i could lose the rental deposit (plus damages) for disobeying any of the above rules. If there is an accident (equipment damage) the estimated charges will be placed immediately on the credit card or from the deposit. I also understand that i could receive a fine and or loss of drivers licence if any of the rules are broken or careless driving activities occur.
